These Terms of Service ("Terms") govern your use of NextSigned ("the platform"). By creating an account or using the platform you agree to these Terms. If you do not agree, do not use NextSigned.
You must be at least 13 years old to use NextSigned. Users between 13 and 18 ("minor athletes") may create an account. A minor athlete may invite a parent or legal guardian to link a guardian account, as described in Section 6 ("Guardian Access for Minor Athletes"). By using the platform you represent that you meet these requirements.
Athletes must be eligible to participate in NIL activities under the rules of their athletic association, school, and applicable state laws. It is your responsibility to understand and comply with your institution's NIL policies.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account and password. NextSigned is not liable for any loss or damage resulting from unauthorized access to your account.
You may not create accounts for others without their permission. You may not use another person's account.
NextSigned reserves the right to suspend or terminate accounts that violate these Terms.
NextSigned is not a party to your NIL deals. We do not post, broker, or negotiate deals, and we do not process payments for them.
Using NextSigned in connection with pay-for-play, or with any deal that violates NIL compliance rules, is strictly prohibited and will result in account termination.
NextSigned is not responsible for ensuring that deals comply with your school's specific NIL policies. Athletes are responsible for their own compliance with applicable NCAA rules, state NIL laws, and federal regulations, and for reporting NIL income for tax purposes.
Athlete Shield subscriptions are charged at the selected monthly rate: Basic (AI) $99.99/month, Pro (AI) $299.99/month, Elite (AI) $499.99/month, or Shield Concierge $799.99/month. The optional Live Escalation add-on is $79.99/month on top of any AI tier. Shield Human is fully human-staffed and quote-only, priced individually. Subscribers on legacy Basic/Pro/Elite plans predating this pricing keep their existing rate unless they explicitly change plans. Subscription fees are non-refundable except as required by law.
All fees are subject to change with 30 days notice.
All Athlete Shield subscription payments are processed by Stripe. By using the paid features of NextSigned you agree to Stripe's Terms of Service.
If an athlete using NextSigned is under 18, NextSigned's guardian system allows the athlete, or NextSigned staff, to invite a parent or legal guardian by email. A guardian who accepts the invitation and creates a NextSigned account agrees to these Terms and to our Privacy Policy in their own right.
A linked guardian may view their athlete's Shield call activity and help manage the athlete's account settings, trusted circle, and Shield subscription. Either the athlete or the guardian may end the link at any time. We record with a timestamp when guardian access begins and ends.
A guardian link recorded through NextSigned does not substitute for any consent, waiver, or disclosure required separately by an athlete's school, athletic association, or state law.
Athlete Shield's Basic, Pro, and Elite tiers provide a dedicated phone number and AI call screening, with no dedicated human agent included. An optional Live Escalation add-on layers on-demand human review and callback on top of any AI tier. Shield Concierge is a separate, dedicated-human-agent product with AI running as a first pass. Shield Human is fully human-staffed with no AI screening step at all, and is quote-only rather than self-serve checkout.
Regardless of tier or add-ons, any call our AI classifies as high-risk (indicators of fraud, threats, coercion, or suspicious payment requests) is automatically escalated to a human reviewer at no additional cost. This safety-net escalation is not a paid feature and is never gated by plan.
Calls to a Shield number may be recorded, transcribed, and analyzed for screening, safety, and fraud-detection purposes. By using Shield, you consent to this recording and monitoring. NextSigned is designed to provide notice where required by law that a call may be recorded, for example through an automated message at the start of the call. Call-recording consent requirements vary by state, and NextSigned does not provide legal advice about how they apply to a specific state.
Shield subscriptions auto-renew monthly until cancelled. Athletes can cancel through the Manage Shield page in their dashboard. Cancellation takes effect at the end of the current billing period.
NextSigned and its service providers are not responsible for calls that are not screened due to technical failures or circumstances outside our control.
Shield is provided as-is. We make no guarantee that Shield will prevent all unwanted or fraudulent contact. The service is designed to significantly reduce but not eliminate all unsolicited communications.
By uploading a photo or other content to NextSigned you grant us a non-exclusive, worldwide, royalty-free license to store and display that content inside the platform for the purpose of operating the service. NextSigned does not publish athlete content: there is no public profile page or athlete directory, and your content is shown only to you, to any guardian you have linked, and to staff who need it to operate the service.
You retain ownership of all content you upload. We do not claim ownership of your photo, bio, or other account content.
You may not upload content that: - Is sexually explicit or contains nudity - Depicts illegal activity - Infringes on another person's intellectual property rights - Contains false or misleading information - Harasses, threatens, or demeans others
NextSigned reserves the right to remove content that violates these Terms.
Call recordings, transcripts, and AI-generated summaries created through Athlete Shield are not "content you upload" under this section. They are used only to operate and improve the screening service and are handled as described in our Privacy Policy.
You may not use NextSigned to:
NextSigned, the NextSigned logo, and all platform content created by NextSigned are owned by NextSigned and protected by intellectual property laws.
You may not use our branding, logo, or platform content without written permission.
The NextSigned platform is built on third-party services including Supabase, Stripe, Vercel, and Resend. Their respective intellectual property belongs to them.
NextSigned is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses.
NextSigned does not provide legal, tax, or financial advice. Nothing on the platform constitutes legal advice regarding NIL compliance, call-recording law, or guardian requirements for minors.
To the maximum extent permitted by law, NextSigned shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
Our total liability to you for any claim arising from your use of NextSigned shall not exceed the greater of (a) the total fees paid by you to NextSigned in the 12 months prior to the claim, or (b) $100.
Some jurisdictions do not allow limitation of liability for consequential damages. In those jurisdictions our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless NextSigned, its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:
NextSigned may suspend or terminate your account at any time for violation of these Terms, for conduct that we determine to be harmful to other users or the platform, or for any other reason at our discretion.
You may delete your account at any time through your account settings or by contacting support@nextsigned.com.
Upon termination your right to use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of South Carolina without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of South Carolina.
We may update these Terms from time to time. We will notify you of material changes by email and by posting the updated Terms on this page. Your continued use of NextSigned after changes take effect constitutes acceptance of the updated Terms.
